Our Terms and Conditions

Welcome to Mahelam HealthCare. By accessing or using our website, you agree to comply with the following terms and conditions.

  1. All products listed are subject to availability and may be modified or discontinued without prior notice.

  2. Prices displayed on the website are subject to change without notice. Applicable taxes and delivery charges will be added at checkout.

  3. Product images are for illustrative purposes only; actual products may vary slightly.

  4. Orders once confirmed cannot be cancelled or modified unless explicitly agreed upon by Mahelam Surgicals.

  5. Medical equipment rentals are governed by separate rental agreements and terms.

  6. Mahelam Surgicals shall not be liable for improper use of medical products contrary to manufacturer guidelines.

  7. All disputes shall be subject to Coimbatore jurisdiction only.

By using this website, you acknowledge that you have read, understood, and agreed to these terms.

 Medical Equipment Rental Agreement

This Rental Agreement is entered into between Mahelam Surgicals (“Lessor”) and the Customer (“Lessee”) for the rental of medical equipment.

1. Rental Equipment

The Lessor agrees to rent medical equipment such as hospital beds, oxygen concentrators, BiPAP machines, wheelchairs, air mattresses, or other medical devices as specified in the rental invoice.

2. Rental Period

  • The rental period begins from the date of delivery or installation.

  • Minimum rental period applies as mentioned at the time of booking.

  • Rental charges are calculated on a monthly basis, unless otherwise specified.

3. Rental Charges & Advance

  • An advance/security deposit is mandatory before delivery.

  • Monthly rental charges must be paid in advance.

  • Rental charges are non-refundable once the rental period has commenced.

4. Delivery, Installation & Removal

  • Delivery and installation charges, if applicable, will be charged separately.

  • Free installation may be provided for select equipment.

  • Removal or pickup charges after rental completion shall be borne by the customer unless otherwise agreed.

5. Condition of Equipment

  • All rental equipment is provided in working condition after inspection.

  • The customer must check the equipment at the time of delivery.

  • Any issues must be reported immediately upon delivery.

6. Usage Responsibility

  • The equipment must be used only for its intended medical purpose.

  • Improper use, mishandling, or unauthorized modification is strictly prohibited.

  • The customer is responsible for ensuring safe usage as per manufacturer guidelines.

7. Damage, Loss & Repairs

  • Any damage, breakage, or loss during the rental period will be chargeable.

  • Normal wear and tear is excluded.

  • Repair or replacement costs shall be recovered from the customer or adjusted against the security deposit.

8. Maintenance & Servicing

  • Routine maintenance due to normal usage will be handled by the Lessor.

  • Issues arising due to misuse or negligence will be chargeable to the customer.

9. No Return or Refund

  • Rental equipment cannot be returned or refunded once delivered and installed.

  • Early termination of rental does not qualify for refund of paid rental charges.

10. Rental Extension

  • Rental extension requests must be informed before the due date.

  • Extended rental charges must be paid in advance.

11. Termination of Agreement

  • The Lessor reserves the right to terminate the agreement in case of non-payment, misuse, or violation of terms.

  • In such cases, the equipment may be repossessed without prior notice.

12. Ownership

  • All rented equipment remains the sole property of Mahelam Surgicals.

  • This agreement does not transfer ownership under any circumstances.

13. Liability Disclaimer

  • The Lessor shall not be responsible for any injury, complication, or outcome arising from the use of rented equipment.

  • Medical supervision and usage responsibility rests entirely with the customer.

14. Force Majeure

The Lessor shall not be liable for delays or failure in service due to events beyond reasonable control, including natural disasters, strikes, or government restrictions.

15. Jurisdiction

All disputes arising from this agreement shall be subject to Coimbatore jurisdiction only.

16. Acceptance of Terms

By renting the equipment, the customer acknowledges that they have read, understood, and agreed to all the above terms and conditions.
